What Is Parental Alienation?

Parental alienation occurs when one parent’s actions cause the child to resist a close relationship with the other parent.

Some examples of parental alienation include:

  • Badmouthing the other spouse in front of the child
  • Questioning the child about the other parent
  • Causing the child to feel guilty about having a good time with the other parent
  • Making the child feel unsafe with the other parent
  • Letting the child decide on court-mandated visits
  • Oversharing divorce details with the child
  • Blaming the other parent for problems
  • Asking the other child to choose which parent he or she loves most

What Can Be Done About Parental Alienation?

Sometimes it can be difficult to take legal action against parental alienation. It’s important to have an experienced lawyer on your side who can evaluate your legal options and help you pursue reconciliation with your child.

If your spouse is outright violating court-mandated timesharing, you may petition the court to modify the timesharing order or order make-up timesharing. The court may decide to impose fines or to take other more serious courses of action.

You also may be able to get a court order that would prohibit your ex-spouse from continuing specific alienating behaviors, such as refusing to let your child keep gifts from you or frequently scheduling events that conflict with visitation.

If you are worried that your child is unsafe with the other parent, you can petition for supervised timesharing.
